This Pet Sitting Contract (“Contract”) is made effective as of ________, by and between ________ of ________ (“Owner”), and Tansie’s Pet Sitting Service, of 521 N Third Street, San Jose, California 95112 (“Pet Sitter”), tansie@tansiespetsitting.com, 1-408-641-7230.

Whereas the Owner wishes to engage the Pet Sitter and the Pet Sitter agrees to undertake the services under the terms and provisions defined in this Contract as well as the Owner’s Information sheet (Exhibit A), Pet Information sheet (Exhibit B) and the Veterinary Release Form (Exhibit C) which shall all become part of this Contract. Any reference to pets in this Contract shall refer to those specified on the Pet Information sheet.

Description of Services. Beginning on ________, the Pet Sitter will provide the following services (collectively, “Services”):

Payment for Services. The Pet Sitter shall be paid the amount agreed upon in the contract for service made prior to the service dates.  There are no deductions made for late departure or early return of the Owner unless previously arranged.

Additional fees may include purchase of necessary items for care of pet including but not limited to pet food, litter or cleaning supplies, transportation, unexpected visits and emergency expenses for health care. The Pet Sitter shall retain and submit receipts as proof of additional expenses and will request permission and discuss expenses prior to making any purchases. We also accept Amazon shipments, etc. that are pre-paid by you for your pet in the event of an emergency, etc.

Termination. Either party may end this Contract prior Termination Date with without cause upon  24 hours written notice other party (“Early Termination”). Upon Early Termination, Tansie’s Pet Sitters will receive pro-rated payment. 

Liability The Pet Sitter accepts no liability for any breach of security or loss of or damage to the Owner’s property if any other person has access to the property during the term of this Contract. The Pet Sitter shall not be liable for any mishap of whatsoever nature which may befall a pet or be caused by a pet who has unsupervised access to the outdoors. The Pet Sitter is released from all liability related to transporting pet(s) to and from any veterinary clinic or kennel, the medical treatment of the pet(s), and the expense thereof. The Pet Sitter is released from all liability of injury to pet(s) caused by other pet(s) or animal(s) not under control of the Pet Sitter.

The Pet Sitter’s total liability for any and all claims, including but not limited to negligence, breach of contract, or any other legal theory, shall not exceed $5,000 USD. This limitation applies to all damages, including direct, indirect, incidental, consequential, or punitive damages, to the fullest extent permitted by law. 

Vaccination and Health Responsibility Clause

The Pet Owner affirms that their pet(s) are current on legally required and recommended vaccinations, including but not limited to rabies, distemper, and parvovirus. The Pet Owner further certifies that their pet(s) are free from contagious illnesses at the time of service. 

The Pet Owner agrees to provide written proof of current vaccinations upon request. Failure to provide proof may result in refusal of service.

The Pet Sitter shall not be held responsible for any illness or injury transmitted between pets, including but not limited to viral, bacterial, or parasitic infections. If a pet becomes ill due to exposure to another pet whose owner misrepresented or failed to disclose vaccination or health status, the Pet Sitter shall bear no liability. The Pet Owner agrees to indemnify and hold harmless the Pet Sitter from any claims arising from such misrepresentation.

California law requires pet sitters to notify owners immediately if a pet becomes sick or injured, unless the owner waives this in writing.

Entire Agreement

This Contract contains entire agreement of parties, and there are no other promises or conditions in any other agreement, whether oral or written.

Severability

If any provision of this Contract shall be held to be invalid or unenforceable for any reason, remaining provisions shall continue to be valid and enforceable. If a court finds that any provision of this Contract is invalid or unenforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

Applicable Law

This Contract shall be governed by laws of  California.

Arbitration/Dispute Resolution: Any dispute or claim arising out of or relating to this Contract, including its breach, shall be resolved by binding arbitration in San Jose, California, in accordance with the rules of the American Arbitration Association. Judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction. Each party shall bear its own costs and attorney’s fees, except as otherwise provided by law.
